What a year it was.
We would like to extend our sincere appreciation to our Attorney and the court for their invaluable assistance and unwavering support throughout the entire legal process. The court proceedings held on June 21, 2023, proved to be highly successful, as the stud owner's attempt to exploit us for additional funds ultimately failed. It is worth noting that the final amount we paid her was actually lower than our initial offer prior to her decision to file a lawsuit. During my testimony in court, I emphasized our commitment to honoring the original proposed amount that was put forward eight months ago. The stud contract was ambiguous as the stud owner introduced extra requirements via email, which were not incorporated into the contract. Furthermore, the court denied the stud owner effort to sell a puppy pick of the litter to a third party.

 

The court mandated the plaintiff, who is the stud owner, to fulfill all the necessary paperwork for the AKC. Once this obligation is fulfilled, she will be eligible to receive the stud fee of $4000, along with interest and a nominal court fee. This ruling brought a tremendous amount of satisfaction, particularly in light of the stud owner previous statement on social media where she vehemently refused to sign the AKC litter Certificate. 

All legal procedures were conducted properly, resulting in a favorable outcome. The stud owner received the original amount we offered, and we obtained our AKC registration successfully. Throughout this challenging experience, the AKC organization provided exceptional support, for which we are very grateful.

We have chosen not to pursue a countersuit at that time, highlighting the importance of this decision. Our legal representative has formally requested the immediate removal of any defamatory content and false accusations from the stud owner social media and other platforms. This request is based on the fact that we have never engaged in any fraudulent activities, making her negative comments unfounded. It is essential to acknowledge that not adhering to this request may lead to a slander lawsuit with grave repercussions, as expressly stated by the magistrate during the court proceedings.

-It is worth mentioning that our first attempt to settle for the stud fee occurred when the litter was only nine days old.

-We made several offers, including an initial offer of $3000 on October 26, 2022,

-followed by a second attempt on October 27, 2022, to reconsider the offer.

-On November 10, 2022, we took the initiative to enhance our proposal to $4000. Although we acknowledged that this amount was exceptionally generous for an 18-month-old stud dog especially given his limited background in external breeding and the absence of any accolades, we remained resolute in our determination to move forward and tackle this matter.

-She provided a response to our email on December 6, indicating that $4000 was deemed as a reasonable sum. Nevertheless, by December 9, she initiated legal action by filing a lawsuit seeking $7000 in compensation.

The stud owner success in her future endeavors is sincerely wished by us, and we hold no ill will towards her. The official finalization was completed through the stud owner signing of a legal court document acknowledging the satisfactory judgment. However, there are posts on her website that raise concerns and may result in a defamation lawsuit. The information on her website does not align or support what actually occurred. New information. As of recently the website of the stud owner has been reviewed, and it appears that the statements have been removed. However, we have obtained screenshots of the content that remained on the website for several months and is still accessible online under the category of justice. This ongoing defamation is unwarranted and unjust. To protect our legal rights, we have proactively informed our legal counsel about any discussions related to our legal matters. In spite of the numerous obstacles posed by this challenging situation, we managed to overcome them and achieve favorable results. Our steadfast dedication and adherence to our principles have earned the trust and backing of breeders who fully support us. Thanks to our persistent efforts, we have successfully raised an outstanding litter of puppies, each of which has been placed in a caring and nurturing home.

Before entering into any business deals, it is crucial to perform a comprehensive background check, as highlighted in the legal proceedings.
